What is a wrongful death claim?


Wrongful death claims are claims which arise upon the death of a victim of the wrongful conduct of others. For such claims to be addressed in Hawaii's courts, generally the cause of action giving rise to such a claim must have sufficient connections to Hawaii so that Hawaii's courts are willing to hear the matter. For individuals harmed through the fault or negligence of another party in Hawaii, Hawaii state law generally provides that the victim is entitled to assert a wrongful death claim. This is usually done through an attorney licensed to practice law in the State of Hawaii. The Ohio Supreme Court has found that the statute of limitations for parental loss of consortium and medical expense claims does not run during the child's period of minority. Fehrenbach v. O'Malley 862 N.E. 2d 489 (Ohio 2007). In other words, the court found that the parents as well as the injured child may be able to assert claims for injuries in Ohio even several years after the wrongdoing occurred - so long as the claims are brought during the child's minority. This result is contrary to current law in Hawaii - See, Kahale v. City and County of Honolulu, 104 Hawai'i 341, 349, 90 P.3d 233, 241 (Hawai'i 2004).
